Tenant fee ban notice
The Tenant Fee Ban law was introduced on 1st June 2019 to protect Tenants in restricting the fees chargeable by agents and landlords. Here at Smart Move in Aylesbury, we are a responsible and reputable Estate Agent, and we abide by the government’s guidance as highlighted in the Tenant Fee’s Act 2019.
Please find a list of permissible charges below, which will be applied should you enter into a tenancy agreement:
- Holding/ Reservation deposit: An Estate Agent can charge you a maximum of equivalent to one week’s rent of your chosen property. We are legally only allowed to hold one holding deposit at any one time.
- Security Deposit: Before your tenancy agreement starts, you are expected to pay a security deposit. All Tenancy Agreements are legally capped at five weeks’ rent for any tenancy agreement up to the value of £50,000.00. Here at Smart Move, we only require our tenants to pay a security deposit for the equivalent of four weeks’ rent.
- Pets: Not all landlords will agree to a tenancy agreement with pets; however, in some cases, the landlord may ask for a slightly higher rental value for the expected wear and tear, depending on the pet the tenant may have.
- Addendums to your tenancy agreement, assignments to a new tenant and tenancy breaches: If the tenant requests to make changes to a term in the contract, such as redecorate the property or maintain a pet, the maximum the agent or landlord can charge you is £50+ VAT.
- Loss of keys and replacement: if the tenant loses a set of keys, they may be charged for a replacement set. This will be evidenced with a receipt, and an invoice will be addressed to the tenant. The agent may also charge you £15 + VAT per hour for the time taken to replace the lost or stolen keys.
- Change of tenant during active tenancy: If the tenant wishes to exit the tenancy early where this has been agreed between the landlord and the tenant at the start of the tenancy agreement, they will be charged a fee for finding a new tenant at the tenant find rate of £350 + VAT. If the tenant has found a replacement, subject to passing reference checks, then the cost the alter the tenancy agreement will be £95 + VAT.
